JUDGEMENT

(1.) The present petition has been filed under Section 482 Cr.P.C. for quashing the FIR No.7 dated 01.02.2011 (Annexure P-1) under Sections 447/436/380/427/148/149 of IPC and Sections 25/27/54/59 of Arms Act, registered at Police Station Jaito, District Faridkot and all the subsequent proceeding arising therefrom, on the basis of compromise dated 29.07.2011 (Annexure P2).
(2.) Brief fact of the case are that the present F.I.R was registered on the statement of respondent No. 2. The complainant was running a electrical shop in a house. On his visit to his sister Asha Rani, who got married in Muktsar, he received a telephonic information that Karan Singh, resident of Hardayal Nagar Jaito, Sonu (Jimwala) resident of near Jim Kalu Di Bagichiwala, Jaton and Naib Singh and some other 15/20 unidentified accomplices who were having gun and arms in their possession have took the possession over the shop of the complainant and residential house at about 2.30 A.M in the night. After reaching home, the complainant saw that they have demolished the shop and took away all the articles lying there in the house by loading them on vehicles and burn some papers. They had also taken the counter and iron box lying in the shop. In the above background, F.I.R. was registered against the petitioners.
(3.) The police is investigating the matter and challan has not been presented yet. However, the matter has now been compromised with the intervention of respectables. As per compromise, respondent No. 2 is the tenant of shop and residential house bearing Municipal No. 393/B2 measuring 14X12 and the owner of the same is petitioner No. 1. the complainant has delivered the possession of the disputed shop and residential house to petitioner No. 1-Karan Singh. Now he has no concern with the shop. The complainant has also withdrawn the complaint which he had filed against the petitioner No. 1. Respondent NO. 2 has no objection if the F.I.R in question be quashed against the petitioners. Affidavit of the complainant is Annexure P-3 wherein he had admitted the factum of compromise.;
