JUDGEMENT

(1.) The petitioner seeks writ of mandamus commanding the
respondent-authorities to consider his case for admission to the
M.B.B.S. Course by grant of weightage under the clause meant for
'weightage to sports person' as provided in the prospectus.
(2.) On the basis of Haryana PMT Entrance Examination,
2012, admission to the M.B.B.S. Course of various Medical Colleges
in the State of Haryana was considered. In the second counselling
held on 12.9.2012, the petitioner produced a gradation certificate
(Annexure P-7), showing his participation in lawn tennis, where he
was graded 'C' to claim 2% weightage on the basis of said
certificate. The petitioner has claimed this weightage in terms of
clause 2 Chapter 10 General Instructions issued on the subject
(Annexure P-4).
(3.) Apart from academic merit, the petitioner claims to be
outstanding sportsman, who has played lawn tennis at the State level
as well as at the National level. Being desirous of admission to the
medical course, the petitioner appeared in the entrance examination
and secured 274th rank in general category. In the combined merit
list, his ranking was 353. On 6.8.2012, the petitioner was issued
gradation certificate by Deputy Director, Sports Department, Youth
Affairs, Haryana, where the petitioner was grade as 'C' in the game
of lawn tennis. The petitioner, thus, claims that he is fully eligible to
2% weightage as per Chapter VI of the prospectus. It is provided in
the prospectus that the candidates claiming such weightage should
submit a certificate issued by the Director of Sports of the State,
stating the grade and period of participation. Certificate from any
other source is not to be accepted. The grades and the weightage for
the same is to be as follows:-
"Grade Weightage of marks
A-1 5%
A-2 4%
B-1 3%
B-2 2.5%
C-1 2%"
