JUDGEMENT
-
(1.) Prayer in this petition is for quashing of FIR No. 12,
dated 28.01.2003, under Sections 420, 494 and 495, IPC,
registered at Police Station, Noor Mehal, District, Jalandhar, and
the consequential proceedings arising therefrom, on the basis of
compromise.
(2.) Vide order dated 18.4.2012, this Court had directed
the affected parties to appear before the learned Trial Court, for
getting their respective statements recorded with regard to the
compromise. The said Court was also directed to send a detailed
report in that regard on or before the date fixed by this Court.
(3.) In compliance of the said order, the petitioneraccused, Ashwani Kumar Verma, and respondent No. 2-
complainant, Anita Mehandru, as well as her attorney, Anil
Kumar, did appear before the learned Judicial Magistrate Ist
Class, Phillaur, and got recorded their respective statements.
Respondent No. 2-complainant stated that she had lodged the FIR
against the petitioner. Due to intervention of the respectable,
she had entered into a compromise with the petitioner. She
further stated that in terms of the compromise, she had received
full and final payment from the petitioner and nothing was due
towards him. She further stated that she did not want to proceed
with the impugned FIR. She also stated that the compromise had
taken place with her free will, without any coercion and pressure.
She also stated that she had no objection if the FIR was quashed.
Anil Kumar, the attorney of respondent No. 2-complainant, also
stated with regard to the execution of the compromise. The
petitioner also suffered statement about the compromise and
further stated about the payment of the cash amount of
Rs. 8,00,000/- to respondent No. 2-complainant, in lieu of the
compromise.;
