JUDGEMENT

- (1.) The prayer made by the petitioner in the instant petition filed under Article 226 is for issuance of directions to the respondents to develop green belt of Sector 17-C, Gurgaon, along with National Highway No. 8 i.e. Delhi Jaipur Road, by way of creating walking tracks and other facilities for the residents/children. It is further prayed that the respondent Haryana Urban Development Authority (for brevity, 'HUDA') may be directed to initiate steps for closure of the doors which have been opened by the residents towards the green belt and to ensure that the green belt is utilised strictly for the public purpose. The development of green belt has also been sought on the same pattern as has been done in other sectors like Sector 14, 15, 15-A (16) and 31 Gurgaon.

It has been submitted by the petitioner that on 11.9.2006, the Administrator, HUDA, Gurgaon-respondent No. 4 had sanctioned an amount of Rs.10.5 lacs for the development of green belt of Sector 17-C, Gurgaon and the work was given to a contractor and some payment was also made to him. But due to the influence of some of the interested persons, who have opened their back doors towards the green belt for their own use and occupation, the development work of green belt was stopped midway. In support of the said assertion, the petitioner has placed on record various photographs of the locality (P-1 to P-5). Thereafter, a number of representations were made by the residents of Sector 17-C, followed by a legal notice, dated 4.12.2009, but no heed has been paid.
(3.) In the written statement filed on behalf of respondent Nos. 2 to 5, it has been stated that no one has been permitted to open backside door towards the green belt. It has further been mentioned that show cause notices were issued to 21 persons who erected such doors in the rear boundary wall of their houses (R-2/1). It is pointed out that out of sanctioned amount of Rs.10.05 lacs, approximately a sum of Rs.1.15 lacs has already been incurred for the improvement of the green belt of the area. In the nutshell it has been stated that every effort is being made to develop the green belt of the area.;
