JUDGEMENT

(1.) Ujjagar Singh, the petitioner by way of Crl. Misc. No.M-5868 of 2011, seeks regular bail while his co-accused Bano Bai in Crl. Misc. No.M-6990 of 2011 and Harbans Singh in Crl. Misc. No.M-20807 of 2011 seek pre-arrest bail in a case registered by way of FIR No. 72 dated 20.05.2009 at Police Station City Jalalabad, District Ferozepur, for an offence punishable under sections 376, 420 and 109 IPC.
(2.) Briefly stated, the case of the prosecution against them is that the complainant Parkash Kaur had been married with Bhajan Singh, son of the petitioners Ujjagar Singh and Bano Bai and elder brother of petitioner Harbans Singh. She had three daughters from her husband Bhajan Singh.
(3.) About 10-11 years ago, Bhajan Singh died due to cancer. After that, she continued staying at her in-laws house alongwith her daughters. The petitioners Ujjagar Singh and Bano Bai, the parents-in-law of the complainant assured the parents of the complainant that Harbans Singh, who was 16-17 years of age at that time, would be married with Parkash Kaur when he would come of marriageable age. On this assurance, the complainant stayed at her in-laws house. About five years ago, Harbans Singh assured her that he will definitely solemnize marriage with her and on the pretext of marriage, he developed illicit relations with her. The complainant disclosed about it to her parents-in-law. They had already given assurance to her and her parents of solemnizing her marriage with Harbans Singh. About quarter to two years back, she gave birth to a male child from the loins of Harbans Singh. She further claimed that the petitioners Harbans Singh and his parents developed ill-will in their mind and refused to solemnize her marriage with Harbans Singh. They even refused to take her son as part of their family. She has also alleged that her parents-in-law in pursuance of a conspiracy hatched between them have engaged their son Harbans Singh with the daughter of Karnail Singh, a resident of Pakka Chisti and thus they have played fraud with her life.;
