JUDGEMENT

(1.) Present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No. 97, dated 06.09.2010, registered under Sections 363, 366, 366(A), 376 IPC, registered at Police Station Qadian, District Batala and subsequent proceedings arising out of the said FIR. Brief facts of the case are that an FIR No. 97 dated 06.09.2010 has been registered on the statement of respondent No.2 Surjit Lal, alleging that his elder grand daughter, namely, Radhika, who is about 16 years and 6 months old, had left the house on 22.08.2010 and she has not returned back. Respondent No.3 while leaving the house took away 4 tolas of gold, Rs.22,000/- in cash and 4 suits. The complainant further alleged in the complaint that respondent no.3 has been kidnapped by the petitioners, on the pretext of marriage without their consent.
(2.) I have heard learned counsel for the parties and perused the record.

Learned counsel for the petitioners contends that petitioner no.1 and respondent no.3 had liking to each other and they wanted to convert this liking into marriage, however, the grand parents of respondent no.3 were against this wish. The grand parents of respondent no.3 forcibly fixed the marriage of respondent No.3 against her wish. Respondent No.3 tried to persuade her grand parents not to marry her against her wishes. When all the attempts of respondent No.3 to persuade her grand parents not to marry her against her wishes failed, she was left with no other alternative but to run away from her house. On 24.08.2010, petitioner no.1 and respondent no.3 performed marriage according to Hindu Rites.;
