JUDGEMENT

(1.) Petitioner contends that adverse remarks were communicated to the petitioner, against which he submitted a representation. The said representation was rejected and the petitioner preferred an appeal before the Director General of Police, Haryana, which was accepted by the Director General of Police, Haryana, vide order dated 22.07.2002. Thereafter, petitioner received a show cause notice from the Director General of Police, Haryana on 23.06.2008 as to why the adverse remarks, which were expunged earlier, be not reconstructed and retained. Petitioner submitted a reply but the same was not accepted, wherein a plea was taken that the same authority has no power to review the earlier order. Reliance has also been placed upon a Division Bench judgment of this Court in the case of Ram Niwas vs. State of Haryana and others, 2007 1 SLR 243, wherein this very issue with regard to the power of review of the Director General of Police has been considered and decided against the same. Petitioner thereafter has preferred a Mercy Appeal/representation to the Financial Commissioner-cum-Secretary to Home Department, Haryana-respondent No. 1 dated 04.05.2009 (Annexure P-9) but no decision thereon has been taken or conveyed to the petitioner till date. Counsel contends that the petitioner, at this stage, would be satisfied if a direction is issued to the Financial Commissioner-cum-Secretary to Home Department, Haryana-respondent No. 1 to consider and decide the Mercy Appeal/representation dated 04.05.2009 (Annexure P-9) within some specified time. Without going into merits of the case or commenting thereon, the present petition is disposed of with a direction to the Financial Commissioner-cum-Secretary to Home Department, Haryana-respondent No. 1 to consider and decide the Mercy Appeal/representation dated 04.05.2009 (Annexure P-9) within a period of two months from the date of receipt of certified copy of this order. Decision so taken be conveyed to the petitioner forthwith.;
