JUDGEMENT

RAM CHAND GUPTA - (1.) THE present petition has been filed for anticipatory bail under Section 438 of Code of Criminal Procedure in FIR no. 149 dated 26.03.2012 under Sections 419/420/120B IPC, registered at police station Civil Lines, Hisar, Haryana.
(2.) I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Additional Sessions Judge, Hisar dismissing anticipatory bail application filed on behalf of the petitioner. This Court while issuing notice of motion on 07.05.2012 passed the following order:- "Crl.M.No.26534 of 2012 Application is allowed subject to all just exceptions. Crl.M.No.M-13167 of 2012 Contends that petitioner is a social worker and obtaining various information under Right to Information Act (for short 'the Act') from various public authorities for using them in public interest. Further submits that earlier petitioner was a teacher in a school, which was being run by the complainant and that he was a whistle-blower and he informed the concerned authorities regarding various instances of acts and omissions made on the part of complainant, D.S.Ranna, while running the said institute and made complaints to various quarters and that action was taken on the said complaints against the complainant.
(3.) IT is further submitted that Jeet Ram, who is a BPL card holder, is also working with the petitioner and that applications for seeking information under the Act used to be filed in the name of Jeet Ram and the same were also used to be signed by him. IT is further submitted that hence, it cannot be said that any offence has been committed by the petitioner if he has used the information as sought by Jeet Ram under the Act for filing complaints against the complainant.
