JUDGEMENT

(1.) The Union of India and others have filed the instant writ petition under Articles 226 and 227 of Constitution of India for issuance of a writ in the nature of certiorari for quashing the order dated 20.5.2011 (Annexure P-3) passed by the Central Administrative Tribunal, Chandigarh Bench, Chandigarh (hereinafter referred to as the Tribunal'), whereby Original Application No. 673-HR of 2010 filed by respondent No.1 Kamaljit Singh for awarding him interest on the delayed payment of retiral benefits has been allowed, and the petitioners have been directed to pay simple interest at the rate of 12% per annum on the delayed payment of the retiral dues of respondent No.1, with effect from the date of his retirement till the date of actual payment thereof.
(2.) We have heard learned counsel for the parties and gone through the impugned order.

In the present case, respondent No.1 was initially appointed as Travelling Ticket Examiner (TTE) Grade-A in the Railways in the year 1978 and subsequently, in the year 1984, he was promoted as Divisional Chief Travelling Ticket Inspector. Thereafter, vide order dated 1.11.1989 (Annexure A-2), in a departmental enquiry, he was awarded the penalty of compulsory retirement with immediate effect. The order of his compulsory retirement was challenged by respondent No.1 before the Tribunal, but the said order was upheld vide order dated 18.7.2001. Civil Writ Petition No. 2583 of 2001 filed by respondent No.1 challenging the aforesaid order of the Tribunal was also dismissed by this Court vide order dated 8.2.2002.;
