JUDGEMENT

RAM CHAND GUPTA - (1.) THE present petition has been filed for anticipatory bail under Section 438 of Code of Criminal Procedure in FIR No.30 dated 21.02.2012 under Sections 420, 465, 467, 468, 471, 120-B of Indian Penal code, registered at Police Station Kotwali Bathinda, District Bhatinda.
(2.) I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Additional Sessions Judge, Bhatinda dismissing anticipatory bail application filed on behalf of the petitioner. This Court while issuing notice of motion on 3.4.2012 passed the following order:- "Crl.M.No.20101 of 2012 Application is allowed subject to all just exceptions. Crl.M.No.M-9662 of 2012 Contends that Rakesh Paul and Bhupinder Kumar are the main accused in this case, who are running coaching centres in the name EIILM University, Sikkim, and issuing fake certificates/degrees in the name of said University. Further contends that petitioner is running a Swastik Educational Charitable Trust (Regd.) Kips Complex, Ajit Road, Street No.9B, Bathinda, and has been duly appointed by the said University vide Memo of understanding, Annexure P3. Further contends that petitioner is not running any alleged fake study centre of that University and that there are no allegations of petitioner issuing any fake certificates/degrees of the said University. It is also contended that main accused Rakesh Paul and Bhupinder Kumar have already been arrested in this case and released on regular bail.
(3.) NOTICE of motion to Advocate General, Punjab, for 1.5.2012. However, in the meantime, petitioner is directed to join the investigation and in case he is arrested, he shall be released on interim bail by the Arresting Officer to his satisfaction subject to compliance of conditions specified under Section 438(2) Cr.P.C.;
