JUDGEMENT
-
(1.) Petitioners have sought quashing of FIR No. 13
dated 18.2.2009 under Sections 406, 498-A IPC registered at
Police Station, Bassi Pathana, Distt. Fatehgarh Sahib, on the
basis of compromise effected between the parties (Annexure
P/2).
(2.) Brief facts of the case are that on 24.11.2001
respondent No.2 was married with respondent No.3. Two
children were born out of this wedlock namely Harmanpreet
Kaur (daughter) and Babalpreet Singh (son). Both the
children were residing with their mother. After the marriage,
the couple could not cope up with the marital relationship
and several efforts were made to patch up the differences
between the couple. Finally, petitioner No.1 got separated
and FIR No. 13 dated 18.2.2009 under Sections 406-498-A
IPC was got registered at Police Station Bassi Pathana,
District Fatehgarh Sahib, against the petitioners and
respondent No.2.
(3.) After investigation, challan was presented and the
matter was at the stage of trial before the trial Court when
the parties entered into a compromise with the intervention
of the respectables to the following affect:-
(i)Smt. Amarjit Kaur w/o late Joga Singh-mother
-in-law -first party is the owner of 3 acres of land
situated in village Hawara Kalan and village
Khamano Kamli and it mutually agreed that 1-
1/2 acre of land owned by Smt. Amarjit Kaur will
be transfer in favour of her grandson
Babalpreet Singh s/o Jagroop Singh whereas
other half share of land will be transferred in
favour of Harmeet Singh, his another son. In
addition to above land, both Harmeet Singh and
Jagroop Singh sons of Amarjeet Kaur are already
in possession of land of their respective shares.
(ii) That half share of residential house will go to
Kamaljeet Kaur and the possession thereof has
already been handed over to her and Kamaljeet
Kaur is residing in the said house with her
children. The remaining half share of the house
will go to another son Harmeet Singh who is
residing with his mother and family.
(iii) That residential house will be divided after
constructing the middle wall including two
rooms, latrine, bathroom, verandah and water
supply would be provided.
(iv) That the dowry which was given to Kamaljeet
Kaur i.e. Party No.1 would be retained by her
exclusively.
(v) Both the parties would withdraw their all civil
and criminal litigation pending in various courts
to maintain harmony, peace and good relations.
(vi) That the first party will have no objection if the
FIR as mentioned above is quashed by the
Hon'ble High Court and the first party would be
bound to make any statement or file affidavit to
that effect if so required.;
