JUDGEMENT

- (1.) Tersely, the relevant facts and material, which require to be noticed for the limited purpose of deciding the core controversy, involved in the instant revision petition and emanating from the record are that, petitioner-accused Jasbir Singh Manocha, while working as a Branch Manager on Extension Counter of Sector-9, hatched a criminal conspiracy with his brother-in-law and co-accused Iqbal Singh(since deceased) and other near relatives. They cheated and defrauded the Punjab & Sind Bank, its customers and account holders, by creating various fictitious entries in their respective accounts and committed misappropriation of about Rs.33 lacs in this respect.

Levelling a variety of allegations and narrating the sequence of events in detail, in all, the prosecution claimed that the petitioner along with his other co-accused, hatched a criminal conspiracy, cheated and defrauded the Punjab & Sind Bank, its customers and account holders, by making various fictitious entries in their respective accounts and committed misappropriation of about Rs.33 lacs. In the background of these allegations and in the wake of complaint of G.S.Rein, the Chief Manager of the Bank, a criminal case was registered against the petitioner-accused, vide FIR No.60 dated 30.05.1995, on accusation of having committed the offence punishable under Sections 420, 467, 468, 471 and 120-B IPC, by the police of Police Station North U.T.,Chandigarh.

After completion of the investigation, the police prepared and submitted 18 challans arising out of the same FIR and the accused were accordingly charge-sheeted by the trial Court, for the commission of the indicated offence. However, the Magistrate after conclusion of trial, acquitted the petitioneraccused, by extending the benefit of doubt, by way of judgment of acquittal dated 28.11.2008.;
