JUDGEMENT

- (1.) Concisely, the facts and material, culminating in the commencement, relevant for disposal of the instant petition and emanating from the record are that, initially in the wake of complaint of complainant-Salim Khan son of Shamsher Khan, respondent No.2(for brevity "the complainant"), a criminal case was registered against the petitioners-accused Karnail Singh and others, by way of FIR No.53 dated 19.05.2011(Annexure P-1), on accusation of having committed the offences punishable under Sections 295-A, 297, 323, 148 and 149 IPC, by the police of Police Station Singh Bhagwantpura, District Rupnagar.
(2.) During the course of investigation of the criminal case, good sense prevailed and the parties have amicably settled their disputes, by means of compromise dated 14.05.2012(Annexure P-2).
(3.) Having compromised the matter, now the petitioners-accused have directed the present petition, to quash the impugned FIR(Annexure P-1) and all other subsequent proceedings arising therefrom, invoking the provisions of Section 482 Cr.P.C., inter alia, pleading that with the intervention of respectables, they have amicably settled their all disputes, vide compromise(Annexure P-2). The complainant has stated that the present criminal case was registered against the petitioners-accused due to misunderstanding and party faction in the village. He does not want to further pursue the matter. Both the parties have decided to live peacefully. The complainant has no objection, if the criminal case registered against the petitioners-accused is quashed. On the strength of aforesaid grounds, the petitioners sought to quash the impugned FIR(Annexure P-1) and all other subsequent proceedings arising therefrom, in the manner depicted hereinabove.;
