JUDGEMENT
Mahesh Grover, J. -
(1.) This order will dispose of C.W.P. Nos.1026 and 8947 of 1994. For the sake of convenience, the brief facts have been taken from C.W.P. No.1026 of 1994.
(2.) The petitioners have filed the instant petitions with a prayer that they be granted special certificate in terms of Article 153(c) of the Haryana Education Code pertaining to teacher service and which is extracted here below:-
"153(c)For Teaching all subject in Secondary Department.
1. The applicant must have passed the B.A./B.Sc. Examination.
2. He/she must have put in 4 years continuous and approved service in Secondary Department upto 31.7.1958 after passing the B.A./B.Sc. examination. Such candidates as have failed in B.T./B.Ed. examination are required to put in two years service in Middle/Secondary Departments upto 31.7.1958 after failure in B.T./B.Ed. examination.
3. He/she must have distinguished himself/herself as a teacher of the subject.
4. He/she must be of good moral character." The facts are not in dispute. The petitioners are graduates having B.A. degree to their credit and were appointed as Math Masters. Being untrained, they were given a fixed salary of Rs.span 550/- as against the regular pay-scale admissible to Math Masters i.e. Rs.span 525-1050. The services of the petitioners were regularised on 26.4.1985 and they continued to draw the fixed pay. Revision of pay-scales took place on 1.1.1986 and the pay of Masters was fixed as Rs.span 1400- 2600. The petitioners were paid the fixed salary of Rs.span 1200/-
(3.) According to the petitioners, on completion of 4 years service and having acquired such experience, they were entitled to special certificate in terms of Article 153(c) (extracted above). It is further their case that they were entitled to similar scale as is admissible to the regular Masters.;
