JUDGEMENT
-
(1.) The petitioners have approached this Court, by way of
instant petition under Section 482 of the Code of Criminal Procedure
(for short 'Cr.P.C.'), invoking its inherent jurisdiction for quashing of
FIR No.215 dated 10.9.2007, under Sections 376, 511, 342, 506,
120-B of the Indian Penal Code ('IPC' for short), registered at Police
Station Shimlapuri, District Ludhiana and the consequential
proceedings arising therefrom, on the basis of compromise
(Annexure P-4).
Notice of motion was issued.
(2.) In compliance of the order dated 16.7.21012 passed by
this Court, the parties got their statements recorded before the
learned trial court. Consequently, report sent by the learned
Additional Sessions Judge, Ludhiana, has been received which is
available on record of the case, along with the statements of the
parties. Learned Magistrate has reported that the parties have made
their statements voluntarily and without any pressure. The
compromise arrived at between the parties has been found to be a
genuine one.
(3.) Learned counsel for the petitioners as well as learned
counsel for private respondents, including the prosecutrix-respondent
No.2), are ad idem that the prosecutrix Ramanjeet Kaur @ Motto
married on her own sweet will with petitioner No.1 Vaneet Pal @
Ballu. They further submit that out of this wedlock, one child was
born. It is further admitted position that petitioner No.1 and
respondent No.2 are still living together as husband and wife.
Learned counsel for the petitioners submits that since the
parties have decided to bury the hatchet and are living peacefully,
continuation of the impugned FIR and subsequent criminal
proceedings arising therefrom, are liable to be quashed in the
interest of justice.;
