JUDGEMENT

(1.) Objections filed on behalf of the petitioner to the report dated 12.4.2012 submitted by the Tehsildar are taken on record.
(2.) The petitioner prays for issuance of a writ of certiorari for quashing order dated 13.3.2008 (Annexure P-10) passed by the Collector-cum-Divisional Deputy Director, Rural Development and Panchayat, Jalandhar and Amritsar and order dated 26.2.2010 (Annexure P-12) passed by the Director, Rural Development and Panchayat Department, Punjab, SAS Nagar, Mohali, respectively.
(3.) The petitioner filed a civil suit against the Gram Panchayat, seeking a permanent injunction. The suit was dismissed on 13.11.1998. The appeal filed by the petitioner was dismissed on 23.4.2002. The petitioner, thereafter, filed a petition under section 11 of the Punjab Village Common Lands (Regulation) Act, 1961 (hereinafter referred to as the "1961 Act") before the Collector, Jalandhar, claiming ownership by pleading that land, in dispute, was allotted to his father, who had executed a registered gift deed on 10.5.1973. The petitioner has been in possession of the suit land since then. The petitioner also pleaded that as there is no path/street, the land does not vest in the Gram Panchayat. The Gram Panchayat filed a reply, denying the contents of the petition and averred that the land, in dispute, is part of a pond that was paved for benefit of inhabitants, and therefore, does not vest in the petitioner. The Collector, appointed one Shri R. P. S. Bhullar, Advocate, as a Local Commissioner to visit the spot. The Local Commissioner made a report that the property marked as Rs. ABCD' is bounded on both sides by streets paved with bricks and the petitioner has raised the level of the land by about 2-1/2 feet.;
