JUDGEMENT

(1.) Jangfulwinder Singh, the petitioner seeks pre-arrest bail in a
case registered by way of FIR No. 78 dated 05.05.2012 at Police Station
City Kharar, District SAS Nagar, Mohali (Punjab), for an offence
punishable under section 420 IPC.
(2.) Learned counsel for the petitioner has submitted that the
petitioner is a young boy, who is a driver. According to him, the story of
the complainant against him is completely unbelievable. He has further
submitted that as per the version of the FIR, the petitioner came to the
house of the complainant and made him and other members of the family
collect their cash and jewellery at the place of worship of their house and
when he left that place, the jewellery and cash were missing. He has further
submitted that the occurrence was dated 13.02.2011 while the complaint
was made on 05.05.2012 and it cannot be believed that the complainant
would remain silent for such a long period, if any such occurrence had
taken place. According to him, the petitioner was implicated falsely in this
case for other reasons. He has further submitted that the complainant
wanted her sister to be married with the petitioner, who lived in England
and when he refused to do so, this false case was got registered.
(3.) Learned counsel for the petitioner has further submitted that a
complaint was previously made to the police by the sister of the
complainant, but as she had returned to England that complaint was not
pursued and thereafter this complaint was made with oblique motive.
Learned State counsel, on the other hand, has submitted that
the petitioner is a person of desperate nature . According to her, there is a
case under section 307 IPC against the petitioner registered in Himachal
Pradesh. She has, however, admitted that the petitioner has joined the
investigation but has claimed that the recovery of the cash and jewellery is
yet to be effected.;
