JUDGEMENT

- (1.) This order will dispose of both the aforementioned petitions filed for anticipatory bail under Section 438 of Code of Criminal Procedure in FIR no.91 dated 12.07.2012, under Sections 420/465/467/468/471/120B IPC, registered at police station Navi Baradari, Jalandhar, District Jalandhar.
(2.) I have heard learned counsel for the parties and have gone through the whole record including the impugned order passed by learned Additional Sessions Judge, Jalandhar dismissing bail applications filed on behalf of the petitioners.
(3.) This Court while issuing notice of motion on 04.10.2012 passed the following order in Crl. Misc. No. M-31079 of 2012:- "Crl.M.No.59411 of 2012 Application is allowed subject to all just exceptions. Crl.M.No.M-31079 of 2012 Contends that petitioner is not, in any way, beneficiary of the alleged forged general power of attorney, which was got executed by Rajinder Singh by impersonating himself as Gurdev Singh. It is further submitted that Rajinder Singh was also identified by Harinder Singh Numberdar and Gurdial Singh Bains, and that present petitioner also signed the said document on the identification of Harinder Singh Numberdar. It is further submitted that moreover no transaction has taken place on the basis of said alleged forged power of attorney. It is further contended that civil litigation is also pending between family members of both the sides as they belong to the same family. It is also contended that moreover dispute has since been settled between Gurdev Singh, who was allegedly impersonated, and Rajinder Singh, who allegedly impersonated Gurdev Singh and Surjit Singh, Avtar Singh and Amrik Singh, i.e., the present petitioner. Notice of motion to Advocate General, Punjab, for 2.11.2012. However, in the meantime, petitioner is directed to join the investigation and in case he is arrested, he shall be released on interim bail by the Arresting Officer to his satisfaction subject to compliance of conditions specified under Section 438 (2) Cr.P.C.";
