JUDGEMENT
-
(1.) Challenge in this revision petition is to the order dated
14.05.2011 passed by Shri A. P. Batra, Additional Sessions
Judge, Amritsar, vide which charge under Sections 306 and 420
IPC is ordered to be framed against the petitioner.
(2.) The law was set in motion by recording the statement
of Bhajan Kaur wife of late Santokh Singh who has stated that
she is resident of Main Rampur, District Amritsar. Her husband
expired 12 years ago. She has three daughters who all are
married. The elder one is Harjeet Kaur who is married with
Amolak Singh-present petitioner about 9/10 years back. Two
sons, namely Kamalpreet Singh and Amanpreet, were born out of
the said wedlock. She has further stated that she was owner of 3
acres of land. Harjeet Kaur and Amolak Singh were living with the
complainant. Her son-in-law borrowed Rs One lac from the
complainant for bringing up his children. Five years ago, she has
sold her land and equally divided the money into her three
daughters. Three years ago, Amolak Singh has committed fraud
with her by transferring her residential house, without informing
her, through a registered document. The complainant has further
stated that she came to know about this fact and she informed
her daughter Ranjeet Kaur who raised dispute with her husband
for committing fraud with the complainant. The complainant and
her family members requested Amolak Singh to get the house
registered in the name of complainant but he refused to do so.
(3.) Ranjeet Kaur was depressed on that account. On 23.05.2010 at
about 10 o'clock in the morning, the complainant, her daughter
Ranjeet Kaur along with her son-in-law Sarabjit Singh were
present at home. Ranjeet Kaur and Amolak Singh were shouting
in the room and Ranjeet Kaur was saying to Amolak Singh that
why he is not transferring the house in the name of her mother
i. e complainant. Ranjeet Kaur was under depression. After
hearing the noise, when they went into the room, Ranjeet Kaur
had already taken some poisonous substance and died at the
spot.;
