JUDGEMENT
S.S. Saron, J. -
(1.) HEARD counsel for the parties.
(2.) THE Petitioner seeks regular bail in a case registered against him for the offences under Sections 302, 398, 120 -B, 148, 149, 201 and 118 IPC; besides, Sections 25 and 27 of the Arms Act. In the incident that occurred on 6.3.2010 at about 1.30 p.m. the Petitioner has not been attributed any overt act. In terms of the supplementary challan that has been filed, the allegations against the Petitioner are that his gun was used at the time of occurrence. During investigation it has been found that the gun was given by the Petitioner to one Balraj Singh for repair. Said Balraj Singh, Satpal Singh etc. handed over the gun to the accused in the case for using the same. Later on they connived with Bharpur Singh, arms dealer and got the gun deposited by ante -dating the date of deposit. The receipt was given to the Petitioner. There is no evidence that the Petitioner gave his weapon for using the same in the crime. It is at the most a case of negligence which is punishable under Sections 29 and 30 of the Arms Act. The co -accused of the Petitioner namely Satpal Singh has been granted regular bail by this Court vide order dated 25.11.2010 (Annexure P2).
(3.) IN the facts and circumstances, the Crl. Misc. petition is allowed and the Petitioner on his furnishing personal bond and surety to the satisfaction of the learned Chief Judicial Magistrate, Moga shall be admitted to bail.;
