Jora Singh, J. - (1.) THIS petition has been filed under Articles 226 of the Constitution of India, for issuance of writ in the nature of Habeas Corpus with a roving writ for the release of detenue namely Amandeep Kaur d/o Surmukh Singh wife of the Petitioner who is stated to be in illegal custody of Respondents.
(2.) LEARNED Counsel for the Petitioner states that Petitioner and the alleged detenue has filed a Crl. Misc. No. 5008 -M of 2011 to protect the life and liberty of the Petitioners and the same is pending for 16.03.2011 in this Hon'ble Court. After arguing for sometime, when this Court was not inclined to issue notice then learned Counsel for the Petitioner submits that he may be permitted to withdraw this petition with liberty to move an application in the earlier writ filed by the Petitioner and the alleged detenue.
(3.) IN view of the above, the instant petition is dismissed with the aforesaid liberty.;
