JUDGEMENT

Augustine George Masih, J. - (1.) COUNSEL for the Petitioners contends that the Petitioners, in response to an advertisement issued in June, 2010 for recruitment of Primary Urdu Teachers, submitted their claim for appointment. He contends that Petitioner No. 1 belongs to a handicapped category and applied in that very category. He obtained higher marks than Respondent No. 3 Noor Mohammad, who also belongs to the same category and has been issued appointment letter. Petitioners No. 2 and 3 belong to the General category and have obtained higher marks than Mohd. Asharf -Respondent No. 4, who has been issued appointment letter whereas none of the Petitioners have been issued appointment letter. He states that the Petitioners having a better right of appointment should have been preferred but instead Respondents No. 3 and 4 have been issued appointment letters. He further states that the Petitioners shall within a period of one week from today file a detailed representation claiming their right against the respective persons who are lower in merit and have been given appointment letters. He further prays that a time bound direction may be issued to Respondent No. 2 -State Project Director, Rashtriya Madhyam Shikhya Authority -cum -Director General Secondary Education to consider and decide their representation within some specified time.

WITHOUT going into the merits of the case or commenting thereon, the present writ petition is disposed of with directions to Respondent No. 2 -State Project Director, Rashtriya Madhyam Shikhya Authority -cum -Director General Secondary Education, to consider and decide the representation, if submitted by the Petitioners within a period of one week from today and take a decision thereon within a period of three weeks from the date of receipt of certified copy of this order. In case the Petitioners are held entitled to the appointment as claimed by them, appointment letters be issued to them forthwith.
(3.) COPY of this order be given dasti under the signatures of the Court Secretary to the counsel for the Petitioners.;
