Alok Singh, J. - (1.) PRESENT petition is filed seeking regular bail in case FIR No. 345 dated 24.9.2010 under Sections 498 -A/306 IPC, Police Station Tripri, Patiala.
(2.) HUSBAND is facing trial for the offences punishable under Sections 306 IPC and 498 -A IPC. As per the contents of FIR, Petitioner -husband was having illicit relationship with other women and used to leave deceased alone in the house for days together that is why deceased has committed suicide. Learned Counsel for the Petitioner has vehemently argued that any harassment without any mens rea to derive the deceased to commit suicide would not amount to abetment, as defined under Section 107 IPC. He has further stated that Petitioner is in judicial custody w.e.f. 25.9.2010 and trial is not likely to be concluded at the earliest.
(3.) CONSIDERING totality of the facts and circumstances of the case and without expressing any opinion on the merits of the case, I direct let Petitioner be released on bail to the satisfaction of the learned Trial Court.;
