JUDGEMENT

- (1.) While issuing notice of motion on 20.7.2011, following contentions of learned counsel for the petitioners were noticed: "Learned counsel for the petitioners submitted that the allegations of trespass are not made out as the alleged occurrence is stated to have taken place in the house of the petitioners themselves. The present FIR was got registered by the complainant for the reason that the father of petitioner No. 2 started living with Manjit Kaur after the death of his wife. After the death of Sucha Singh, his property was inherited by his two sons and mutation was also entered. Thereafter Manjit Kaur forged the Will allegedly, executed by Sucha Singh to claim that she was also bequeathed part of the property in terms of the Will. However, the Will was found to be forged as Manjit Kaur claimed that Kulvir Singh and Jasvir Singh sons of Sucha Singh were in fact born out of the wedlock of Sucha Singh with Manjit Kaur but the age of Jasvir Singh and Kulvir Singh was found to be more than 32 years whereas Manjit Kaur was merely about 41 years of old. Learned counsel for the petitioners further submitted that in fact, Manjit Kaur started living with Subeg Singh, the complainant after the death of Sucha Singh and this Will was also forged with his connivance. The FIR was got registered on June 20, 2011 after the Assistant Collector Ist Grade found that the Will produced by Manjit Kaur was forged and fabricated document vide order dated 14.6.2011."
(2.) Learned counsel for the State, on instructions from ASI -Sunny Khanna, submitted that the petitioners have joined investigation. Considering the aforesaid facts, the interim bail granted to the petitioners on 20.7.2011 is made absolute.;
