JUDGEMENT

Ranjan Gogoi, C.J. - (1.) THIS PIL has been filed seeking interference of the Court with the restoration of the licence to the Respondent No. 4 for running a ration depot at village Chalk Ghubai @ Tara Wala, District Ferozepur.
(2.) THE affidavit filed by Respondent No. 3 would go to show that by order dated 22.9.2009 the licence of the Respondent No. 4 was suspended on the basis of a complaint dated 2.9.2009 alleging certain anomalies in the distribution of the food items to the card holders by the said Respondent. Thereafter, a Show Cause Notice dated 19.10.2009 was issued to the Respondent No. 4 and an opportunity of personal hearing was afforded to the said Respondents on 19.1.2010. By order dated 22.1.2010 (Annexure R1) the licence of the Respondent No. 4 was restored and forfeiture of the security amount of Rs. 1,000 was ordered. However, it appears that on the basis of another complaint dated 10.2.2010 (Annexure P1) the licence of the Respondent No. 4 was again suspended by an order dated 23.2.2010. We are told that the aforesaid suspension of the licence of the Respondent No. 4 continues as on date. The restoration of the licence of the said Respondent by the order dated 22.1.2010 will, therefore, be governed by such orders as may be passed in the matter in which the said licence has again been suspended on 23.2.2010. In the above circumstances and as the licence of the Respondent No. 4 remains under suspension as on date we direct the Respondents No. 1 to 3 to pass final orders with regard to the licence of the Petitioner after giving him an opportunity to controvert such allegations as may have been levelled against him. The Respondents No. 1 to 3 will finalize the matter within a period of six weeks after receipt of a copy of this order.
