Hemant Gupta, J. - (1.) PRESENT petition is for appointment of an Arbitrator under Section 11 of the Arbitration and Conciliation Act, 1996 (for short the 'Act') in respect of the dispute arising between the parties out of an Agreement dated 5.11.2005.
(2.) MR . Batra does not dispute that there exists disputes between the parties out of the said Agreement and the same is required to be decided by an Arbitrator in terms of the following arbitration clause in the Agreement: 30. That in case of any dispute(s) and difference (s) arising between the parties in relation to this Agreement then the matter will be referred to Arbitration under the Arbitration and Conciliation Act, 1995. The Arbitration proceedings shall be held at New Delhi. In view of the said fact and with the consent of both the parties, Hon'ble Mr. Justice Mukul Mudgal, former Chief Justice of this Court, resident of H. No. C -30, Ist Floor, Nizamuddin East, New Delhi is appointed as an Arbitrator.
(3.) LEARNED Arbitrator may fix his fee in consultation with the parties on the first date of hearing.;
