JUDGEMENT

(1.) HEARD counsel for the Petitioner.
(2.) THE Petitioner seeks pre -arrest bail in a case registered against her on 08.04.2010 for the offences under Sections 419, 420, 467, 468, 201 and 120B IPC at Police Station Mullana, District Ambala. The FIR has been registered on the complaint of Kuldip Singh. It is alleged by the complainant that he and Satpal are owners of land measuring 29 Kanals 8 Marlas since the time of their forefathers. This land has been recorded in the name of as many as 40 persons whose names are mentioned in the FIR. The complainant had asked the share holders for purchase of the land in question being in possession but they refused to sell. From amongst the share holders, some share holders had already died. Despite their death, the share holders of the land in connivance with each other got sale deed dated 28.02.2008 pertaining to 6 Kanals and 11 Marlas of land registered in favour of Subhash Chand. The said sale deed was executed by impersonating the dead persons. The Petitioner -Krishna is said to have impersonated in place of Krishni who had already died.
(3.) IN order to elicit information and material regarding the impersonation by the Petitioner and others, the custodial interrogation of the Petitioner would be necessary. Besides, it is to be kept in view that in a case of pre -arrest bail, the advantage of custodial interrogation for eliciting more information and material is to be kept in view. The exercise of power to grant pre -arrest bail is somewhat extraordinary in nature. Keeping in view the allegations as made in the case, no ground for grant of concession of pre -arrest bail to the Petitioner is made out.;
