JUDGEMENT
Ranjit Singh Sarkaria, J. -
(1.) THE counsel pleads that the respondent could not prove herself to be the legally wedded wife of the petitioner. Even it be so, that is not sufficient to deny maintenance in the background of factual position in the case.
(2.) THIS is a case where the petitioner has played fraud with the respondent, who is widow. The petitioner is a Police Constable and has played fraud with respondent to get married to her. The petitioner posed himself to be a widower and, thus, got married to the respondent. The fact that the petitioner has a living wife revealed to the respondent late. Enquiry has already been held, which has found the petitioner guilty of the said allegation, leading to punishment. The petitioner in fact has committed a criminal misconduct for which a case can be registered against him for performing second marriage fraudulently. He may even be responsible for committing sexual offences. The petitioner perhaps has escaped action in this regard because of being a Constable. Law must take its own course. Let the Superintendent of Police of the District look into the same and take action, if any criminal offence is revealed against the petitioner. No case for interference in the present petition is made out.
