JUDGEMENT
Ajay Tewari, J. -
(1.) THIS is a petition for anticipatory bail filed in case bearing FIR No. 39 dated 07.07.2010, under Sections 420, 120 -B IPC registered at Police Station Mataur, Distt. Mohali.
On 15.02.2011 the following order was passed:
Learned Counsel for the Petitioner contends that the Petitioner himself has been duped and has parted with a huge money to sponsor his admission in a College at United Kingdom. He further submits that the Petitioner is not aware as to how Nirmal Singh, Travel Agent, has fabricated the documents, especially the bank statements.
Issue notice of motion for 7.3.2011.
Meanwhile in the event of arrest, the Petitioner shall be admitted to interim bail on his furnishing personal an surety bonds to the satisfaction of the Arresting/Investigating Officer. The Petitioner shall, however, join the investigation as and when called for and he shall also abide by the conditions as specified under Section 438(2) Code of Criminal Procedure.
Thereafter on 07.03.2011 the following order was passed:
Counsel for the Respondent has stated that though the Petitioner has joined the investigation but he had undertaken to produce Ranjit Singh who had allegedly witnessed the money transaction between the Petitioner and Nirmal Singh.
Counsel for the Petitioner states that the Petitioner will produce Ranjit Singh before the police on 11.3.2011 at 10 a.m.
Adjourned to 31.3.2011. Interim order to continue.
(2.) LEARNED DAG, on instructions from SI Harkeerat Singh, has corroborated that Ranjit Singh was, in fact, produced before the then investigating officer but states that now the investigation has been transferred to the Economic Offences Wing and, therefore, the Petitioner should be directed to appear before the new investigating officer. Learned Counsel for the Petitioner states that he would have no objection but that the anticipatory bail granted to the Petitioner should be confirmed.
I find it to be a fair request.
In the circumstances order dated 15.02.2011 is made absolute subject to the conditions envisaged in Section 438(2) Code of Criminal Procedure, up to the filing of the challan, whereafter the Petitioner would be required to seek regular bail. However, the Petitioner is directed to report to the investigating officer on 07.04.2011 between 11.00 a.m. to 4.00 p.m. and subsequently also as and when required.
