JUDGEMENT

- (1.) This court on 16.03.2011 has passed the following order:- "Learned counsel for the petitioner contends that although proceedings under Section 7 of the Punjab Village Common Lands (Regulation) Act, 1961 cannot be initiated at the instance of an inhabitant of a Village, however, disturbing facts have been brought to the notice of Director, Department of Rural Development and Panchayat, by way of application dated 18.01.2011 (Annexure P-5). It has been clearly shown that certain elements are taking illegal possession of Gram Panchayat land and are manipulating the revenue record. An application has also been made to the Senior Superintendent of Police, Police District, Batala, District Gurdaspur, as is evident from Annexure P-6, yet no action has been taken. Notice of motion. On the asking of the Court, Shri A.K. Sharma, Additional Advocate General, Punjab, accepts notice on behalf of respondents No.1 to 4 and 6. Requisite number of copies of the writ petition have been handed over to Shri Sharma. Adjourned to 03.05.2011. Respondent No.5 be served by way of dasti process as well as by Registered A.D. post. In the meantime, District Development and Panchayat Officer, Gurdaspur, is directed to have an inquiry conducted as regards the allegations made in the petition and file a report before this Court one week before the next date of hearing. Copy of the order be given dasti to Shri Sharma under the signatures of the Court Reader, for onward transmission to the District Development and Panchayat Officer, Gurdaspur."
(2.) Mr. Raghbir Chaudhary, learned Senior Deputy Advocate General, Punjab assures that positive action shall be taken on Annexure P/5 within 30 days from today. If Director, Department of Rural Development and Panchayat -- respondent No.2 is prima facie satisfied that there is encroachment over the panchayat land, he will direct the official(s) to initiate eviction proceedings against the encroachers.
(3.) On the statement made by the learned Senior Deputy Advocate General, Punjab, learned counsel for the petitioner states that present petition be disposed of in terms of the aforesaid statement.;
