Kanwaljit Singh Ahluwalia, J. - (1.) THIS petition has been filed under Section 482 Code of Criminal Procedure praying that directions be issued to Respondent No. 3 - DSP City - 1, Moga not to harass the Petitioner and his family members.
(2.) THIS Court, on May 30, 2011, had passed the following order: During the course of arguments, Counsel for the Petitioner has leveled serious allegations against Respondent No. 3 and it is stated that the Petitioner is a bona fide resident of Jalandhar and his car was snatched by Respondent No. 6 at Jalandhar, and who later on, had used this car in a crime. Furthermore, Respondent No. 6 has given an undertaking before Economic Offences Wing at Jalandhar that the car shall be restored back to the Petitioner. Counsel for the Petitioner states that Respondent No. 3 is a relation of Respondent No. 6, and to deprive the Petitioner of the car, a false story has been created and the Petitioner is sought to be implicated at Moga. Shri Sra has stated that all police officials act impartially. On the observations made by this Court, as to whether enquiry into the complaint submitted by Respondent No. 6 can be entrusted to any other police officer within District Moga, Counsel for the State submits that an adjournment be granted to seek necessary instructions in this regard. List on 2.6.2011. Today, Shri Sra, on instructions from Commissioner of Police, Jalandhar, has stated that any enquiry report submitted by Respondent No. 3 shall not be taken into consideration and a fresh enquiry shall be conducted by Dr. S. Bhupati, Assistant Commissioner of Police, Jalandhar.
(3.) COUNSEL for the Petitioner states that the present petition be disposed of in terms of the statement made by Counsel for the State. Ordered accordingly.;
