JUDGEMENT

(1.) I have gone through the record.
(2.) THE brief facts of the present case are that the petitioner had filed a Criminal Misc. Petition seeking indulgence of this Court to hand over the investigation to Central Bureau of Investigation in case FIR No. 77 dated 15.07.1995, Police Station Civil Lines, Patiala, under Section 302 IPC registered against Inspector Gurnam Singh. Vide order dated 09.05.1997, this Court was pleased to entrust the investigation to the Central Bureau of Investigation, New Delhi, with direction to complete the same within six months. But despite the specific order passed by this Court, no action was taken, therefore, petitioner filed COCP No. 1415 of 1997 and this Court vide order dated 24.02.1998 dismissed the same. The relevant part of the order is as under: -
I have heard counsel for the parties. There is nothing on the record to show that the order dated 09.05.1997, whereby, the investigation of the case was entrusted to the C.B.I. was ever received by the latter. Be that it may, now the case as directed by this Court has been registered by the C.B.I. and in view of the undertaking given by the learned counsel appearing for the respondent, the investigation will be completed expeditiously.
Thereafter, CBI moved various applications for seeking extension of time and finally, a Crl. Misc. No. 3057 -M of 1997 was moved wherein the CBI was granted three months' time vide order dated 04.02.1999.
(3.) THE allegation of the petitioner is that inspite of the specific order dated 04.02.1999, the respondent has not taken any action and the final report has not been presented in the Court so far against the accused.;
