JUDGEMENT
Alok Singh, J. -
(1.) PRESENT petition is filed by the Petitioner under Section 438 of the Code of Criminal Procedure seeking anticipatory bail in case FIR No. 165 dated 16.09.2010, under Section 380/406 I.P.C., registered at Police Station Sadar, Ludhiana.
(2.) THE complainant has lodged FIR against the Petitioner with the following allegations:
...Accused Rajinder Kaur Madhu, who was her neighbourer was familiar with her. She visited her in the jail and shown sympathy for her. She assured that they would represent them in the cases for Crl. Misc. No. M -380 of 2011 getting justice. Thereafter, all the accused stated that they are required money for proceeding with the cases. As the complainant was in jail and she issued three blank cheques bearing her signatures along with two ATM cards. Accused also took keys of her house on the pretext that they would look after the house. When the complainant came out of the jail, she came to know that accused withdrew the amount of Rs. 139000/ -on the basis of cheques and they also withdrawn huge amount through ATM Cards. When she made search, she came to know that her gold articles, two gold sets, one gold set of three tolas, all silver jewelry, four gold kara's of 3 gram each and four mobile phones were stolen. She was having suspicion that the applicants have stolen the same....
In the opinion of this Court, the recovery of items said to have been stolen and amount said to have been withdrawn by using ATM Cards of the complainant and cheques issued by the complainant and thorough investigation for which custodial interrogation would be required. No case is made out for anticipatory bail.
