JUDGEMENT

- (1.) Present petition has been filed under Section 438 Code of Criminal Procedure seeking pre-arrest bail to the Petitioner in case FIR No. 271 dated 15.10.2010 registered at Police Station Sadar Amritsar under Sections 323/324/452/506/148/149 IPC.
(2.) A Coordinate Bench, on December 20, 2010 had passed the following order: Learned Counsel for the Petitioner contends that the Petitioner has falsely been implicated in the case and all offences except under Section 452 IPC are bailable. As per allegations in the FIR, Petitioner has caused injury with kirpan on the three fingers of the complainant and that injury is simple in nature. Learned Counsel further contends that the Petitioner is ready to join the investigation. Notice of motion to Advocate General, Punjab for 7.3.2011. In the event of arrest, the Petitioner shall be released on interim anticipatory bail to the satisfaction of the investigating officer. He shall join the investigation as and when required by the investigating officer. He shall also comply with the conditions as envisaged under Section 438(2) of the Code of Criminal Procedure, which are as under: (i) that the Petitioner shall make himself available for interrogation by a police officer as and when required; (ii) that the Petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; (iii) that the Petitioner shall not leave India without the previous permission of the Court.
(3.) Counsel for the State, on instructions from Kewal Singh ASI, Police Station Sadar Amritsar, has stated that in pursuance of the order reproduced above, Petitioner has joined the investigation and is no longer required for custodial interrogation by the investigating agency.;
