JUDGEMENT

(1.) THIS is a petition under Section 482 of the Code of Criminal Procedure wherein a prayer has been made that the passport of the petitioner be returned to her so as to enable her to take a journey abroad in order to enable her to take care of her children.
(2.) REPLY to the petition has been filed by way of an affidavit of She. Satpal Singh, Deputy Superintendent of Police, Moga wherein in para 1, it has been stated as under: -
That at the time of moving application for grant of Passport, Veerpal Kaur petitioner mentioned her date of birth 13.4.1984 and the name of her father as Ajaib Singh Brar and the name of her mother was mentioned as Jaswinder Kaur Brar. These facts are mentioned in Passport File No. A -041287/05. At the time of moving application for grant of passport for the second time, she mentioned her date of birth as 13.4.1982 and the name of her father as Hari Singh and name of her mother as Gurnam Kaur. These facts are mentioned in the Passport File No. A -20936/07. It is pertinent to mention here that it transpired from the investigation that Hari Singh and Gurnam Kaur are father -in -law and mother -in -law respectively of Veerpal Kaur and they are not her father and mother as alleged. Moreover, accused/petitioner produced fake Ration Card, Fake Driving Licence and Fake School Leaving Certificate, Fake Marriage Certificate for issuance of Passport from Passport Authority. On the basis of those forged documents, Passport No. G3039452 was issued to the petitioner by the Regional Passport Office, Chandigarh. Now the passport of the petitioner has already been revoked by the Regional Passport Office, Chandigarh. After completion of necessary investigation, the challan against the accused has been presented in the Court of Sessions / Special Judge, Faridkot on 23.4.2011 and the case is now fixed for 15.10.2011.
A perusal of the aforesaid contents of the reply reveal that passport of the petitioner stands revoked on account of false information furnished by her.
(3.) IN this view of the matter, this Court, in the exercise of its powers under Section 482 of the Code of Criminal Procedure, does not deem it proper to grant the prayer of the petitioner.;
