JUDGEMENT

Laxmi Narain Mittal, J. - (1.) ACCUSED Onkar Singh @ Kalu has filed this petition for anticipatory bail in case FIR No. 131 dated 12.09.2011 under Sections 363 and 366 -A of the Indian Penal Code (in short - IPC), registered at Police Station Sadar, District Hoshiarpur.
(2.) I have heard learned counsel for the parties and perused the case file. According to the prosecution version, the petitioner kidnapped complainant's daughter aged 17 years and 02 months and allegedly performed marriage with her.
(3.) COUNSEL for the petitioner contended that the prosecutrix has performed marriage with the petitioner and they are residing together. However, the prosecutrix is minor aged 17 years 02 months at the time of kidnapping. Consequently, prima facie offences under Sections 363 and 366 -A IPC are made out from the prosecution version.;
