JUDGEMENT
Ranjan Gogoi, C.J. -
(1.) THIS PIL has been filed seeking the Court's interference with the re -alignment of the route for construction of 400 KV Gurgaon -Manesar D/c Quad T/L at village Saketpur. According to the Petitioner, the re -alignment, which has been sought to be explained on the basis of a sketch map (Annexure P2), involves extra cost of several crores of rupees and the same has been done only to ensure that the route does not run through farm houses and the golf club which have been indicated in the aforesaid sketch map. It is in the aforesaid facts that interference of the Court has been prayed for.
(2.) WHAT should be the ideal route for a transmission line is primarily a technical question that should be decided by the experts. Merely because the Petitioner has alleged that the alteration of the route has been made to favour certain individuals such an allegation would not be sufficient for the Court to interfere with the ultimate decision which has to be taken on a consideration of a host of technical issues. In view of the above, the Court is not inclined to entertain this PIL at this stage, particularly, when from the materials on record it transpires that the Petitioner has filed a representation dated 01.02.2011 (Annexure P6). As a representation highlighting the issues raised in the writ petition has been filed by the Petitioner and the same is yet to be answered, we are of the view that it would be more appropriate for us to direct an early disposal of the Petitioner's representation dated 01.02.2011 (Annexure P6). The concerned authority will so act and pass a reasoned order after taking into account the facts stated in the said representation including the public interest involved. Such orders will be passed by the concerned authority within a period of six weeks from the date of receipt of a certified copy of this order.
(3.) IF the Petitioner continues to entertain any further grievance in respect of the order to be passed in terms of the present directions, it will be open for him to avail of such remedies as may be available in law.
This will dispose of the PIL.;
