JUDGEMENT
K. Kannan, J. -
(1.) THE appeal is for enhancement of compensation for death of a male, aged 32 years. The claimants originally were widow, three minor children and the mother. A child in the womb at the filing of the petition was later born and there was evidence by the mother that the posthumous child was conceived when the deceased Jasbir Singh died in the accident.

THE evidence of the claimant -widow was that her husband was running a business of karyana -cum -general store and he was also making an earning by the sale of bangles and that he used to hand over Rs.3,000/ -to meet the household expenses. In the absence of any documentary evidence, the Tribunal took the income at Rs. 1,500/ -and determined a compensation of Rs. 1,97,000/ -,which included Rs. 5,000/ -for loss of consortium without love and affection. The enhancement is sought on the basis of the assessment of income was low and the deduction for personal expenses was also on the higher side. It is contended by the learned Counsel that in 1990, he could not support a large family at Rs. 1,500/ -. It is unfortunate that this evidence was not proved but I will go with what the widow stated that her husband used to give Rs. 3,000/ -for household expenses. I will take the income at Rs. 3,000/ -make a deduction of 1/4th and also provide for loss of love and affection for the minor children @ Rs. 2,500/ - in addition to what was provided by the Tribunal. I tabulate the compensation with the conventional heads of claim for loss to estate and funeral expenses as well:

(3.) THE amount in excess over what has been determined by the Tribunal already shall attract interest at 6% from the date of petition till date of payment.;
