JUDGEMENT

Ranjit Singh Sarkaria, J. - (1.) THE Petitioners have filed the present writ petition for quashing of office order dated 20.8.2007, which has removed the pay anomaly amongst junior and senior employees and whereby the Respondents have not revised the pay scales of E -01 to E -02A at par and proportionate to the categories and at par with other power utilities as also in providing higher scale to the feeder cadre than the promotional cadre.
(2.) THE Petitioners today have filed a misc. application for placing on record Annexure P -12, which is a response given to an information sought under the Right to Information Act. The counsel would refer to response to a query contained in Annexure P -12, which is as under: (a&b): It is for NHPC to implement the revised Pay Scale w.e.f. 01.01.2007 in accordance with the guidelines of DPE. However, NHPC has referred a proposal to this Ministry seeking parity with the Pay Scales of NTPC for executives below board level. NHPC has cited removal of anomaly in E1, E2 & E2A grade as one of the reason for seeking parity with NTPC Pay Scales. (c&d): It is proposed to regularize the Pay Scales from 1997 already being drawn by the executives of below board level with the approval of Cabinet. The proposal is yet to be recommended for Cabinet for approval, as such channel of submission cannot be indicated. However, the proposal is proposed to be referred to the Cabinet only with the approval of Hon'ble MOP. Since the matter is under consideration with the Respondents, it would be appropriate to dispose of this writ petition with a direction to the Respondents to consider and decide the same within time bound period. The Respondents are already seized of the anomalies and have taken action to either remove or correct the same.
(3.) THE writ petition is accordingly disposed of with a direction to the Respondents to consider and take an appropriate decision in accordance with law within a period of six months from the date of receipt of copy of this order.;
