JUDGEMENT

- (1.) All these writ petitions are at the instance of the candidates who had applied online for consideration for selection of Hindi Teachers by Raashtriya Madhyamik Shiksha Abhiyan Authority. In the advertisement issued calling for applications, it had been specified that the candidates would have to apply online from 14.1.2012 to 4.2.2012 and the Clause (viii) of the advertisement regarding how to make the application online contained references to an instruction that candidates were." The contention of all the respective petitioners were that they were under the belief that they had to visit the particular website mentioned in the advertisement even for the results. They had not appeared on a particular day said to have been fixed for counselling after enumeration of marks on the basis of the academic qualifications obtained. The qualifications prescribed were Graduate degree/10+2 from the recognized Board two year diploma and depending on whether a person had secured first division, second division or third division marks were assigned. It is not denied that all the petitioners had sent their applications online and in the order of merit they were required to be considered for selection within the vacant seats that were advertised. However, all the petitioners claimed that they had not known about the results till the respondents had purportedly finalized the list of selected candidates and they had not been selected in spite of the fact that they were higher up in merit and entitled to consideration for selection.

The contentions by the contesting respondents are that the results had been announced in newspaper and different website had been given where the results had been shown and the petitioners will have to take the blame for themselves not looking at the advertisement published in the newspaper giving the details of the results. It is further contended that the website was given in the advertisement only for the purpose of making the application online and the candidates could not have been expected to secure the results also in the same website.
(3.) ' Apart from the general contentions that the petitioners knew the results or at any rate, bound to have followed the newspaper advertisements about the results. It is contended in respect of the petitioner in CWP No. 7856 of 2011 that it was never the contention of the petitioner that she had not known the fact that the result had been announced and that she was required to appear for counselling on a particular date. The counsel for the respondents would rely on the representation given by the petitioner on 29.12.2010 where she has stated as follows:- With due respect, it is submitted that I applied for appointment against 455 posts of Hindi Teachers of C.S.S. I got rant No.66 in the merit list. Registration No.thereof is 12100578. My registration No.for the posts of Hindi Teachers in S.S.A. is 20015165. I could not attend the counselling due to my domestic problems.";
