JUDGEMENT

Jasbir Singh, J. - (1.) PETITIONER Iqbal Mohammad is undergoing imprisonment passed qua FIR No. 163 registered on 5.9.2005 under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985. It is allegation against him that he was found in possession of 12 bags of poppy husk without any licence. For the above offence, vide order dated 26.7.2007, he was sentenced to undergo RI for a period of 12 years and to pay a fine of Rs. one lac.
(2.) IN this petition, it is stated that marriage of the petitioner's daughter is fixed on 10.12.2011. Notice of motion was issued on 30.11.2011. Today in Court verification report of SHO PS City -2, Malerkotla dated 4.12.2011 has been put on record, contents of which read thus: It is requested that Head Constable Baljit Singh No. 157 was deputed to verify the marriage of Namely Jarina d/o Mohd Iqbal, Caste Parjapat Ghumiar Muslim, r/o Mana Fatak Malerkotla. He verified that the father of Jarina namely Mohd Iqbal is undergoing imprisonment in district Jail Sangrur to undergo RI for 12 years in case FIR 163 dated 5.9.2005, us 15 NDPS Act, PS Malerkotla and the marriage of Jarina has been fixed on 10.12.2011 with Sikandar Khilji son of Doctor Rafiq Khilji. Mohd Iqbal has applied for parole to arrange/ attend the marriage of his daughter. The Head Constable Baljit Singh No. 157 verified that the marriage of Jarina daughter of Mohd Iqbal has been fixed on 10.12.2011. Photo copies of marriage Card, Voter Card and Ration Card are attached herewith. The local police has no objection for release on parole to Mohd Iqbal. Counsel for the petitioner states that the petitioner is not involved in any other case and earlier he was granted benefit of parole and after expiry of the period of parole, he surrendered before the jail authorities and has not committed any default.
