JUDGEMENT

S.S. Sodhi, J. - (1.) The claim in appeal here is for enhanced compensation. The claimant - Col. Kartar Singh Singhota sustained serious injuries when while travelling on his scooter, he was involved in an accident with the Punjab Roadways bus PUD-3489 coming from behind. This happened at about 11-30 AM on September 14,1981 near the Arti Cinema, Ludhiana After holding that the accident had been caused, wholly due to the rash and negligent driving of the bus-driver, the Tribunal awarded a sum of Rs. 98,829.40 paise as compensation to the claimant.
(2.) In the matter of the quantum of compensation payable to the claimant, it would be J relevant to advert to the medical evidence brought on record which consists, in the first instance, of the statement of P.W. 2 - Dr. D.S.K. Malagar, Registrar in the Department of Orthopaedics at the Christian Medical College, Hospital, Ludhiana. He deposed that on his admission to the hospital, on September of 14,1981, the claimant had five injuries on his person, namely: (1) Closed fracture of left femur; (2) Open fracture both bones left leg; (3) Degloving injuries left leg. (4) Close fracture left medial malleolus. (5) Fracture Pelvis with rupture urethra.
(3.) It was further the testimony of Dr.Malagar that the claimant remained admitted in the hospital till December 13,1981 and on discharge, he left with left leg cast and supra-public cathetar. On June 7,1982 when this witness made this statement, he also deposed that the claimant was still undergoing treatment in the hospital.;
