JUDGEMENT

- (1.) The order will also dispose of Civil Writ Petition N x 13761 of 1989 as the question of law and fact involved in both these petitions is identical.
(2.) The petitioners are working as teachers and allied staff in the privately managed recognised schools of district Ferozepur. The respondent-State had decided to introduce Grant-in-aid Rules dated 22-3-1968 under which the privately managed recognise schools were granted parity of pay-scales and allowances and the Government under took to pay 95 per cent of the Grant in-a id to meet the deficit on account of pay and allowances to the teachers and allied staff payable to the privately man aged recognised schools staff at the rate at which their counterparts in Government schools arc paid and the Managements are required to meet only 5 per cent of the d -licit on this account. The Government had taken a decision to pay allowances other than the dearness allowance to the employees of the privately managed recognised schools so that the disparity in the pay and allowances can be removed. This was done on the introduction of Delhi Pattern of Grant-in-aid Rules, 1967 and Section 7 of the Punjab Government Privately Managed Recognised Schools Employees (Security of Service) Act, 1979 vide Annexure P-l. The respondent-State had decided to pay House Rent Allowance to the employees of the privately managed recognised schools in the State of Punjab, with effect from 1.4.1985 at the rate and on the conditions on which it was admissible to the employees of the Government of Punjab.
(3.) The respondent-State had taken a policy decision whereby the employees posted in the city/town/villages falling with 10 miles belt of the International Border of Ferozepur, Amritsar and Gurdaspur districts irrespective of take classification of city, were to be paid rent free accommodation or in lieu thereof, house rent allowance.;
