JUDGEMENT

(1.) This order of mine would dispose of Civil Misc. No. 2063-CII of 1990 as well as F.A.O. No. 507 of 1984.
(2.) The original petition was filed under Sections 31 of the State Financial Corporations Act, 1951 (hereinafter referred to as the Act), which was allowed. Since Misc. expenses were not granted in tems of the application, the Punjab Financial Corporation has come up in appeal. In this application it has been stated that the applicant wants to withdraw the appeal itself which was filed under Section 32 of the Act, as the amount is not being recovered and undue hurdles are being created by the judgment-debtor in discharging the liability in question. The appellant reserves its right to seek any other remedy available to it, including the one under Section 29 or the Act.
(3.) After reading the averments made in the application, which is signed by Shri G.S. Sewak, who is Legal Advisor of the Corporation, this Court is satisfied that the permission should be granted to withdraw the petition filed under Section 31 of the Act and that the Corporation is permitted to seek any other remedy available to it under the provisions of the Act, including the remedy under Section 29 of the Act.;
