JUDGEMENT
M.R.Agnihotri, J. -
(1.) Learned counsel for the petitioner states that when the writ petition was admitted on October 28,1988, a direction was issued by the Motion Bench that no further promotion will be made in the vacancy occurring on October 31, 1988. This order was later modified on January 25, 198', and it was directed that the respondents shall consider the case of the petitioner for promotion against any vacancy available It was further directed that in case the petitioner was found entitled for further promotion, he would also be reimbursed with regard to the arrears of salary with effect from the date his juniors were promoted. Later on, these orders were further clarified on the undertaking given by Mr. D.S. Brar, the then Deputy Advocate General, Punjab, that the order of promotion to the post of Deputy Director shall be passed by passing a speaking order.
(2.) Learned counsel further contends that persons junior to the petitioner have since been recruited and on May 7, 1990. some persons for junior to the petitioner have also been promoted as Deputy Directors. This, according to the learned counsel, is in utter violation of the directions issued by this Court and harms the service prospects of the petitioner.
(3.) Mr. S.S. Saron, AAG Punjab, prays for short adjournment to enable him to have instructions in the matter and to file a detailed reply to the civil miscellaneous application. The request is genuine and is granted. The respondents are directed to file a detailed reply to the civil miscellaneous application by July 10, 1990. It is further directed that the respondents shall also consider the case of the petitioner for retrospective promotion and make the record available to Mr. Saron at the time of hearing in the Court, so that appropriate orders are passed by the Court. A copy of this order shall be supplied by the office to Mr. Sandhawalia by 8th June, 1990, for onward transmission to the State Government. Ordered accordingly.;
