JUDGEMENT

M.R. Sharma, J. - (1.) The appellant was in service as an Assistant Sub Inspector of Police. He prayed for being retired on Jan. 12, 1973, because he had put in the requisite service which enabled him to seek voluntary retirement This request made by him was not accepted On May 26, 1973, he was reverted to the rank of Head Constable and then retired from service on April 14, 1974. Thereafter he was allowed to cross the efficiency bar with retrospective effect from May 9, 1975.
(2.) The grievance made by the appellant is that he had been reverted in rank with the object of punishing him so that he may not earn the pension admissible in the case of an Assistant Sub Inspector. In support of this argument, the point pressed into service is that be had been allowed to cross the efficiency bar with retrospective effect and a presumption can be raised that his service record was good
(3.) On behalf of the respondents, Mr. Bachittar Singh has argued that the appellant had been promoted to the post of Assistant Sub Inspector on ad hoc basis because regularly appointed or promoted A. S Is. were available. The learned counsel submitted that a person who was promoted on ad hoc basis could be reverted to the substantive rank any time when the Government desires.;
