JUDGEMENT

SUKHDEV SINGH KONG,J. - (1.) The two petitioners having qualified the Bachelor of Veterinary Science and Animal Husbandry Examination in the year 1959 were recruited as Assistant Veterinary Surgeons on September 11, 1959, on ad hoc basis. However, the petitioners were selected by the Public Service Commission in the year 1960 as Assistant Surgeon and were appointed on regular basis that very year. Later on they were confirmed on these posts.
(2.) That in the wake of Chinese Aggression, the President Proclaimed Nation Emergency on the 26th of October, 1962. In order to attract larger number of young men, who otherwise were not inclined to adopt soldiery as a career, the State of Punjab announced a number of concessions through circular letter No. 29 (GOI) S-II (3)-73/7752 dated the 28th of February, 1963 to the ex-servicemen and civilian employees, who undertook military service during emergency. The benefits included a relaxation in the age limit and educational qualifications at the time of joining the civil posts or services, the counting of the period of approved military service towards seniority, promotion, increments, leave and pension. Those instructions were superseded by another letter dated the 8th of July, 1963. However, the same concessions continued with slight modifications.
(3.) Induced by these representations of concessions and benefits made by the State of Punjab, the petitioners' offered themselves for military service. Petitioner No. 1 at that time was doing his M. Sc. (Dairying)at the Dairy Science College, National Dairy Research Institute, Karnal as be had been granted study leave for this purpose. He was selected and appointed as a Lieutenant in October, 1963 in the R.V.C. (Remount Veterinary Corps) He was promoted as Officiating Officer Commandant(Captain) with effect from October 11, 1966. Thereafter he was promoted as Executive Veterinary Officer (in the rank of Major) on August 5, 1972. He was released from the Army on May 26, 1975 in pursuance of the Government Policy. His work and conduct throughout the service with the Army was goon and for that reason, he earned various promotions.;
