JUDGEMENT

(1.) The petitioner, Dr. Kuldip Chand, passed his M. B. B. S. Examination in December, 1973, from Government Medical College, Patiala, obtaining in aggregate 63.83 per cent marks. Thereafter he completed one year's internship on 14th of January, 1975, and was posted as a House Physician from 15th of January, 1975, to 30th of June, 1975, at Rajendra Hospital, Patiala, in the Department of General Medicine. From 1st of July, 1975, to 20th of July, 1975, he was posted as a House Surgeon in the Orthopaedics Department at the same hospital. From 29th of July, 1975, to 12th of June, 1976, he worked as 1st Year Junior Resident in the Department of Psychiatry at the Post Graduate Institute of Medical Education and Research, Chandigarh. His earlier period of house job in General Medicine was not completed due to the reason that the session had commenced late and, therefore, to enable him and others to complete their period of six months' house job, a special session was held from 13th of January, 1976 to 27th of January, 1976, which he also attended and thereby completed his six months' house job in General Medicine. In this manner he worked for a period of one year and 5 days of house job in three specialities.
(2.) On 22nd of March, 1976, the petitioner was appointed in P. C. M. S. Class II on ad hoc basis and worked from time to time as Medical Officer in- charge in Rural Dispensaries or Primary Health Centres. He was selected through the Punjab Public Service Commission and was appointed to the P. C. M. S. Class II on regular basis in September, 1977.
(3.) In order to make the members of the P. C. M. S. Class II eligible to qualify for the M.D./M.S. Examinations, the Punjab Government, vide notification dated 11th of October, 1979, laid down the criteria for their selection, the relevant extract from which has been attached with the writ petition as Annexure P-1. In pursuance of the criteria, the Director, Research and Medical Education, Punjab, issued a notice vide his letter dated 19th of October, 1979, inviting applications from the members of the P. C. M. S. Class II, for appointment as Registrars. The posts of Registrars are available only where Medical Colleges are situate, that is, at Patiala and Amritsar. The petitioner as also many other doctors, including Dr. Parshotam Dass Garg, respondent No. 5, and Dr. Maheshwar Datt Sharma, respondent No. 6, submitted their applications. The petitioner had given his first preference for the post of Registrar in the Department of Psychiatry and second preference for General Medicine.;
