JUDGEMENT
Surinder Singh, J. -
(1.) The petitioner stands convicted under Sec. 16(1)(a)(i) and 16(1)(a)(ii) of the Prevention of Food Adulteration Act. On the former count, he was sentenced to six months Rigorous Imprisonment and a fine of Rs. 1,000.00 in default to undergo further Rigorous Imprisonment for three months. On the second count, he was sentenced to three months Rigorous Imprisonment and a fine of Rs. 500.00 in default to undergo further Rigorous Imprisonment for one month. Both the sentences were ordered to run concurrently. His appeal before the Additional Sessions Judge failed and hence this Revision Petition.
(2.) The charge against the petitioner is that he was found in possession of cow's milk, out of which a sample was taken which was later found to be adulterated in the sense that it was fund to be deficient of milk solids not fat by only 0.5 per cent. There is no deficiency in the milk fats.
(3.) In the wake of the solid evidence produced by the prosecution to support their allegations, the learned counsel for the petitioner has not challenged the conviction of his client, and rightly so. Sohan Lal, Food Inspector (P.W. 1) and Dr. Joginder Singh who was senior to the Food Inspector are the witnesses in this behalf. Their testimony is without blemish. The conviction of the petitioner is, therefore, maintained.;
