JUDGEMENT
S.S. Dewan, J. -
(1.) Dev Raj petitioner was charged with being in possession of 20 Kgs. of adulterated ladus of Besan and was convicted under section 16 (1)(a)(i) of the Prevention of Food Adulteration Act, is 54 (hereinafter called, the Act) and sentenced to six months rigorous imprisonment and a fine of Rs. 2000.00 and in default to undergo rigorous imprisonment for lour months by the Chief Judicial Magistrate, Jullundur. On appeal, the learned Sessions Judge, Jullundur in a detailed order upheld the conviction and sentence of the petitioner. The petitioner has now come up by way of revision.
(2.) The prosecution case in brief was that on 16-4-1975 Dr. P.N. Sondhi, Food Inspector alongwith other members of the raiding party including Dr. M.S. Dhall visited the shop of the petitioner. After disclosing his identity he purchased 600 gms. of ladus out of those kept by the petitioner for sale. Documents were prepared and attested by the witnesses. After completing the formalities a part of the sample was sent to the Public Analyst for examination. The public analyst submitted a report after examination of the sample that it was adulterated as the sample was found to contain metanil yellow coal tar dye. On receipt of the report, the Food Inspector filed a complaint before the Magistrate against the petitioner under the aforementioned section.
(3.) The prosecution, examined Dr. P. N. Sondhi and on his evidence, a charge under the afore-mentioned section was framed against the petitioner to which he pleaded not guilty. He resisted the case on several grounds, alleging contravention of various provisions of the Act and of the rules made thereunder. The trial court as well as the appellate court repelled all the contentions of the petitioner and found him to be guilty of the offence he was charged with.;
